The www.tonicdm.com website and the TonicDM cloud-based software application, including all related tools, APIs, documentation, and support services made available via the tonicdm.com domain and through any associated integrations and mobile applications (collectively, the “Service") is operated by Design Management Technologies Inc. (“DMT”), a company incorporated in Delaware, USA. This privacy statement applies to the data collected by DMT through use of the Service.
At DMT, we take your privacy seriously. Please read this Privacy Statement to learn how we treat your personal data and the data of the organization to which you belong. Unless your Organization has signed a separate agreement with DMT: By using or accessing our Service in any manner, you acknowledge that you accept the practices and policies outlined below, and you hereby consent that we will collect, use and share your information as described in this Privacy Statement.
Your use of the Service is at all times subject to our Terms of Use, which incorporates this Privacy Statement. Any terms we use in this Statement without defining them have the definitions given to them in the Terms of Use.
Your Relationship with your Organization
If you sign into the Service using an email address that belongs to an organization, your account is part of the account of your Organization and all text, files, and other data input, uploaded or otherwise provided to the Service (“Customer Data”) fall under the control of your Organization. THE OWNERSHIP OF DATA YOU UPLOAD RESIDES WITH YOUR ORGANIZATION.
Customer Data
“Customer Data” means all text, files, and other data input, uploaded or otherwise provided to the Service by you and others at your Organization, including contact information for your organization's contacts.
We make no claim of ownership in your Customer Data. Except as provided in this Privacy Statement, we only use Customer Data to provide and enhance the Service and complete the transactions you request.
We don’t share your Customer Data in any form, be that raw, aggregated, or anonymized, with anybody except in the limited circumstances described in the Sharing of Information section below.
DMT Contact Data
“DMT Contact Data” is contact data owned by DMT. This includes the contact information of the Users of our Service, including name, address, phone number, email address, title, time zone and other information that we may collect through use of the Service.
We may use DMT Contact Data to administer your account, contact you to provide notifications regarding activities on the Service, information about billing and important updates about the Service, including information about security or other technical issues, and detect and prevent fraud. We may also contact you regarding third-party inquiries as described in this Privacy Statement and Terms of Service. You may not be able to unsubscribe from some of these communications.

Service Usage Data
“Service Usage Data” is metadata collected on your and your organization's use of the Service, including derived statistical data, analytics, and trends. We use Service Usage Data to operate, improve and personalize the Service. The Service Usage Data for your organization is available to your Organization.
We don’t share Service Usage Data in any form, be that raw, aggregated, or anonymized, with anybody except in the limited circumstances described in the Sharing of Information section below.
Support Data
Support Data is the information we collect when you submit a support request or run troubleshooting tools, including information about hardware, software, and other details related to the support incident, such as contact or authentication information, chat session personalization, information about the condition of the computer and the application when the fault occurred and during diagnostics, system and registry data about software installations and hardware configurations, and error-tracking files.
Support may be provided through phone, e-mail, or online chat. We may use remote access technologies, with your permission, to temporarily navigate your desktop. Phone conversations, online chat sessions, or remote access sessions with support staff may be recorded and/or monitored. For online chat or remote access, you may end a session at any time of your choosing.
We use Support Data to resolve your support incident and for training purposes. We don’t share Support Data in any form, be that raw, aggregated, or anonymized, with anybody except in the limited circumstances described in the Sharing of Information section below.
Cookies & Other Information
The Service uses “cookies”, which are small text files placed in a device’s storage by a web server. We may use cookies and similar technologies for storing users’ preferences and settings, to authenticate users, to collect usage data and operate the Service.
Sharing of Information
We will not disclose Customer Data, DMT Contact Data, Service Usage Data, Support Data (“your information”) outside of the Organization with which you are associated or DMT itself except as you direct, or as described in this privacy statement.
Accessing and Correcting Your Information
You may access and correct your Contact Data you have provided to us by using the tools within the Service (for example, editing your profile information on the Service) or by contacting support using the contact information at the bottom of this document. Changes you make to your information on the Service take immediate effect, but data will be retained in secure storage for a limited period afterward as part of our standard data backup process.
Deleting Your Information
If you sign into the Service using an email address that belongs to an organization, your account is part of the account of your Organization and all text, files, and other data input, uploaded or otherwise provided to the Service (“Customer Data”) fall under the control of your Organization.
If you wish to close a non-organizational account or the account of your Organization, you may request this by contacting your account representative or emailing support@tonicdm.com. Upon termination of services, DMT shall delete all Customer Data from active and backup systems within 90 days, unless otherwise required by applicable law.
Security
We have implemented and will maintain appropriate technical and organizational measures, internal controls, and information security routines intended to protect your information against accidental loss, destruction, or alteration; unauthorized disclosure or access; or unlawful destruction. Data Location
Customer Data and DMT Data is stored and processed in the United States.
Changes to this Privacy Statement
We will occasionally update this Privacy Statement to reflect customer feedback, changes in our Service, and updates to applicable data privacy laws and regulations. We will provide at least 30 days prior written notice for any material changes to this Privacy Statement, including by email to the Organization's primary contacts. Continued use of the services after such notice constitutes acceptance of the revised Statement.
